These Terms of Service ("Terms") govern your access to and use of the fhbo-usa platform, APIs, and associated services. Please read them carefully before using our services.

By accessing or using any fhbo-usa platform, API, documentation, or related services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree, you must discontinue use immediately. Your continued use following any posted updates constitutes acceptance of those changes.
fhbo-usa provides financial API integration infrastructure designed for the modern U.S. banking and fintech market, including but not limited to payment rails, data aggregation endpoints, compliance modules, and developer tooling. Services are provided on an as-available basis and may be modified, suspended, or discontinued at our discretion with reasonable notice. All services are intended for lawful commercial use by authorized business entities.
To access the fhbo-usa API, you must register for an account and provide accurate, complete, and current information. You are solely responsible for maintaining the confidentiality of your API credentials, keys, and account passwords. You must notify fhbo-usa immediately at [email protected] if you suspect any unauthorized access to your account.
Subscription and usage-based fees are billed in U.S. dollars according to the plan selected at time of order. All fees are due in advance unless otherwise stated in a written agreement, and are non-refundable except as expressly provided herein. fhbo-usa reserves the right to modify pricing with 30 days' written notice.
All API endpoints, software, documentation, trademarks, and content made available through fhbo-usa are the exclusive intellectual property of fhbo-usa or its licensors and are protected by U.S. and international intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the APIs solely for your authorized integration purposes. You may not reverse-engineer, reproduce, sublicense, or create derivative works without prior written consent.
You agree not to use fhbo-usa services for any unlawful purpose, including money laundering, fraud, sanctions evasion, or any activity that violates the Bank Secrecy Act, FinCEN guidelines, or other applicable U.S. financial regulations. Automated scraping, excessive API calls beyond documented rate limits, or attempts to circumvent security controls are strictly prohibited. Violations may result in immediate account suspension and referral to relevant authorities.
fhbo-usa processes data in accordance with its Privacy Policy, available at fhbo-usa.com. You are responsible for ensuring that any personal or financial data you transmit via the API complies with applicable U.S. privacy laws, including GLBA and applicable state regulations. fhbo-usa implements industry-standard encryption and security controls but cannot guarantee absolute security of data in transit.
The fhbo-usa platform and all related APIs are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. fhbo-usa does not warrant that the service will be uninterrupted, error-free, or free of harmful components. You use the service at your own risk.
To the fullest extent permitted by applicable law, fhbo-usa and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the service, even if advised of the possibility of such damages. fhbo-usa's total cumulative liability to you for any claim shall not exceed the fees paid by you in the three (3) months preceding the event giving rise to the claim.
Either party may terminate this agreement upon 30 days' written notice. fhbo-usa may suspend or terminate your access immediately and without notice if you breach these Terms, fail to pay fees, or engage in prohibited conduct. Upon termination, your license to use the APIs ceases and you must destroy all fhbo-usa credentials in your possession.
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising hereunder shall be resolved by binding arbitration administered by JAMS in Wilmington, Delaware, except that either party may seek injunctive relief in a court of competent jurisdiction. You waive any right to participate in a class-action lawsuit or class-wide arbitration.
